Terms and Conditions.
Overview and acceptance
These Terms and Conditions describe the general rules for accessing the DAN Marketing Agency website and requesting information about its services. By using the website, visitors agree to use it in a lawful and responsible manner. A request for information does not, by itself, establish a client relationship or a commitment to deliver services.
Who we work with
DAN provides information about digital marketing, creative production, brand development, website development, analytics and related consulting services. The availability, suitability and scope of a particular service depend on the project and the parties’ written agreement.
Website use
Visitors must not misuse the website, attempt unauthorized access, introduce malicious code, disrupt availability, impersonate another person, or submit unlawful, misleading or infringing materials. We may take reasonable steps to protect the website and its users.
Information on the website
Service descriptions, examples, portfolio materials, educational articles and other information are provided for general information. They may be updated without advance notice. Illustrations, estimates and examples should not be interpreted as guaranteed outcomes or binding offers.
Inquiries and communications
Visitors may contact DAN to discuss a project or request a proposal. When sending an inquiry, provide accurate contact information and information you are authorized to share. A response, meeting or preliminary discussion does not automatically constitute acceptance of a project.
Proposals and scope of work
A project proposal may identify objectives, deliverables, responsibilities, timelines, assumptions, fees and exclusions. A proposal becomes binding only as specified in the applicable written agreement or other expressly accepted terms. Any material change in scope should be documented and agreed by the parties.
Client materials and approvals
Clients are responsible for supplying materials, access and approvals needed for their projects, unless a written agreement states otherwise. Clients should ensure they have the necessary rights to provide text, images, logos, customer data, accounts and other materials for use in the work.
Project timelines and dependencies
Project schedules may depend on timely client feedback, content, technical access, third-party platforms and other prerequisites. Target dates and delivery milestones should be defined in the project agreement. Changes or delays affecting dependencies may require a revised schedule.
Revisions and change requests
The number of revisions, feedback rounds, review periods and treatment of work outside the agreed scope should be stated in the applicable proposal or contract. Requests beyond the agreed scope may require additional time or fees, subject to prior agreement.
Fees, invoices and payments
Pricing, currency, taxes, deposits, invoice dates, payment methods and due dates are project-specific and should be set out in the written agreement or invoice. No universal payment schedule or refund entitlement is established by this website page.
Cancellation, suspension and termination
Cancellation rights, notice periods, treatment of work already performed, prepaid amounts and access to deliverables should be governed by the relevant agreement and applicable law. DAN and clients should address any interruption or termination in writing.
Intellectual property on this website
Unless otherwise stated, DAN’s website design, copy, graphics, branding and original materials may be protected by intellectual property law. Visitors may view the content for personal or internal business evaluation but should not reproduce or commercially exploit it without appropriate permission.
Ownership of client deliverables
Ownership, licensing, transfer of source files, rights to drafts, and permitted use of completed work depend on the specific project agreement. Third-party fonts, photographs, plugins, software, templates and other licensed assets may remain subject to their original licensors’ terms.
Portfolio and case studies
Project examples are intended to illustrate types of work. Any reported metrics should be interpreted in the context, period and methodology stated with them. Historical results are not a promise of future performance. Use of client names or materials in a portfolio should respect applicable permissions and agreements.
Third-party platforms and services
Some services depend on platforms such as search engines, advertising networks, social media, website hosts, analytics providers or other vendors. Their policies, availability, algorithms and fees are controlled by those providers. Separate third-party terms may apply.
Advertising and marketing performance
Campaign reach, ranking, traffic, leads, sales and other outcomes can be affected by competition, budget, audience behavior, platform changes and external market conditions. No particular commercial result is guaranteed unless explicitly stated in a separately executed agreement.
Confidentiality and data protection
Handling of confidential business information, personal data, credentials and account access should follow the applicable contract, DAN’s Privacy Policy and relevant law. Visitors should avoid submitting sensitive credentials or confidential information through ordinary website forms.
Security and account access
Where a project requires access to third-party accounts, the parties should agree on suitable authorization, roles, security procedures and handover arrangements. Users should not send passwords through unprotected public channels.
External links
Links to external websites are provided for convenience and do not necessarily imply endorsement. DAN does not control the accuracy, security, availability or privacy practices of independent third-party websites.
Availability and changes
We may update, maintain, modify or temporarily suspend parts of this website for operational or security reasons. We aim to provide accurate information but cannot promise uninterrupted access or that all content will always be free from errors.
Limitations and applicable rights
Nothing in these general website terms is intended to exclude rights or responsibilities that cannot lawfully be excluded. Any project-specific liability provisions must be agreed separately and remain subject to applicable law.
Disputes and governing terms
The identity of the contracting party, governing law, dispute-resolution process and any jurisdiction provisions should be specified in the applicable signed service agreement. This website page does not independently select a court or impose a universal jurisdiction for all projects.
Changes to these terms
The information on this page may be revised as services, technology and business practices evolve. Material contractual changes to an existing client engagement should be handled in accordance with the parties’ agreement.
Contact
For questions about these terms, a proposal or an existing engagement, contact DAN through the contact details provided on this website. For an active project, refer to the communication and notice requirements in your agreement.
For clarification, please contact DAN.
Contracting entity and agreement consistency
Who provides DAN services
Services marketed under DAN (Digital Advertising Network) are offered by GAMA Marketing Agency LLC, a Delaware limited liability company, United States. DAN is used as a trade/brand name; this statement does not represent that a separate DBA registration has been independently verified.
Business mailing address: 2055 Limestone Rd STE 200C, Wilmington, DE 19808, United States. This address is for business identification and correspondence, not a representation of a staffed office.
Consistent commercial terms for marketing packages
Minimum term: six consecutive service months unless a signed agreement states otherwise. Payment: monthly in advance, due before the first calendar day of the service month; if the first falls on a weekend or applicable public/bank holiday in the contractually designated billing jurisdiction, the due date is the immediately preceding business day. The signed agreement must identify that jurisdiction and payment method.
Early termination: substantial strategy, onboarding, production planning and reserved capacity can be incurred at the outset. Amounts attributable to services performed, documented preparation, and valid non-cancellable third-party commitments may be retained or charged as permitted by the signed agreement and applicable law. No provision eliminates mandatory statutory cancellation, refund or remedy rights; disputed or undelivered services are reviewed individually. Any remaining-term charges must be expressly agreed and legally enforceable.
Contract documents: a signed Master Services Agreement (if used), signed order or proposal, and the package-specific Schedule A specify the exact deliverables, quantities, fees, revisions, approval windows, third-party costs, governing law and jurisdiction. If documents conflict, the signed agreement controls to the extent permitted by law. Website descriptions alone are not a signed service agreement.
Payment security: banking instructions are supplied on an authenticated invoice or separately verified payment notice, never by relying on public website content. Do not send funds to changed account details without independent confirmation.
Marketing package contract schedules
Marketing S, M, L, XL, XL Pro and Enterprise 360° are offered subject to a signed six-month minimum service schedule unless a different term is expressly agreed. Monthly service fees are normally paid in advance by the first day of each service month, moved to the last preceding working day when that date is a weekend or recognized bank/public holiday in the billing country named in the agreement.
Advance fees may cover genuine onboarding, research, strategy, resource allocation and services already performed. Refunds, cancellation charges and remaining-term fees are subject to the executed agreement and applicable mandatory law; they do not eliminate remedies for non-performance or material breach. Third-party media, software and supplier commitments must be separately identified.
Each signed Statement of Work should specify the package's actual quantities, fees, channels, approvals, exclusions, billing jurisdiction, holiday calendar and deliverable acceptance process. Compare package scopes.
